Purposes and Legal Bases for Data Processing

We process your data only for specified purposes and only in legally permissible cases. The following reasons may serve as legal bases:

  • Your consent;
  • The execution of a contract or pre-contractual measures;
  • Compliance with legal regulations;
  • Our legitimate interests, provided they do not override your interests;
  • To protect vital interests of you or another person or to perform a task in the public interest;
  • Other relevant legal bases.

If you have given us consent to process your personal data for specific purposes, we process your data within the scope of this consent, provided we have no other legal basis.

You can revoke your consent at any time. Data processing that has already taken place is not affected by this revocation.

Disclosure to Third Parties

a) Principle

We may need to use third-party services or services from affiliated companies and entrust them with processing your data (so-called processors). Categories of recipients include specifically:

  • Affiliated companies (propertyowner.ch financial AG, propertyowner.ch family office AG)
  • Accounting, fiduciary, and auditing companies;
  • Consulting firms (legal advice, taxes, etc.);
  • IT service providers (web hosting, support, cloud services, website design, etc.);
  • Financial service providers (banks, payment processing services, debt collection, etc.);
  • Providers of tracking, conversion, and advertising services;

We ensure that these third parties and our affiliated companies comply with data protection requirements and treat your personal data confidentially.

We may also be required to disclose your personal data to authorities.

We work with various companies and partners in the real estate industry that post their offers on our website. It is recognizable to you that it is a third-party offer.

If you use such an offer, we process your personal data for the purpose of forwarding it to these partners or collaborative companies (e.g., name, role, communication, etc.). These partners and collaborative companies are independently responsible for the received personal data. Their privacy policies apply.

c) Visiting Our Social Media Channels

We have embedded links to our social media channels on our website. This is visible to you (typically via corresponding icons). When you click on the icons, you are redirected to our social media channels.

d) Disclosure Abroad

In the context of order processing, your personal data may be transferred to companies abroad. These companies are obliged to protect data to the same extent as we are. The transmission can take place worldwide.

If the data protection level does not correspond to that of the European Economic Area (EEA) / Switzerland, we conduct a preliminary risk assessment and ensure contractually that the same protection as in the EEA / Switzerland is guaranteed (e.g., using the new standard contractual clauses of the EU Commission or other legally prescribed measures). If our risk assessment is negative, we take additional technical measures to protect your data. You can access the standard contractual clauses of the EU Commission at: https://ec.europa.eu/info/system/files/1_en_annexe_acte_autonome_cp_part1_v5_0.pdf

Retention Period

We store personal data only as long as necessary to fulfill the individual purposes for which the data was collected.

Data that we store during your visit to our website is generally retained for twelve months. An exception applies to analysis and tracking data, which can be stored for a longer period.

We store contract data for a longer period as we are required by legal regulations. In particular, we must retain business communications, concluded contracts, and booking receipts for up to 10 years. As soon as we no longer need such data to perform services, the data is locked, and we use it only for accounting and tax purposes.

Data Security

We will keep your data secure and therefore take all reasonable measures to protect your data from loss, access, misuse, or changes.

Our contractual partners who have access to your data are also obliged to comply with data protection regulations. In some cases, it may be necessary for us to pass on your inquiries to affiliated companies. Even in these cases, your data will be treated confidentially.

Within our website, we use the SSL procedure (Secure Socket Layer) in conjunction with the highest level of encryption supported by your browser.

Obligation to Provide Certain Personal Data

In some cases, you are required to provide us with certain personal data to enter into business relationships. Without such data, we are usually unable to conclude a contract. The website cannot normally be used if certain data for ensuring data traffic (such as the IP address) is not disclosed.

You can request information about the data we store about you at any time. We ask you to send your request for information together with proof of identity to info@propertyowner.ch.

You also have the right to receive your data in a common file format if we process your data automatically, and if:

  • You have given your consent for the processing of this data; or
  • You have provided data in connection with the conclusion or processing of a contract.

We can restrict or deny the disclosure of information or data if this contradicts our legal obligations, legitimate own or public interests, or the interests of a third party.

The processing of your request is subject to a legal processing period of 30 days. However, we may extend this period due to a high volume of inquiries, for legal or technical reasons, or because we need further information from you. You will be informed about the extension of the deadline in due course, at least in text form.

b) Deletion and Correction

You always have the option to request the deletion or correction of your data, provided no legal retention obligations or a legal permission stand in the way.

Please note that exercising your rights may conflict with contractual arrangements and have corresponding effects on the performance of the contract (e.g., premature termination of the contract or cost consequences).

You are always entitled to revoke any consent you have given for the use or processing of personal data with effect for the future.

Our website uses Google Analytics, a service of Google Ireland Ltd., Google Building Gordon House, Barrow St, Dublin 4, Ireland, and Google LLC, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA; both together “Google,” with Google Ireland Ltd. responsible for the processing of personal data. Google uses cookies that are stored on your device and enable an analysis of your use of the website. The information generated by the cookie about your use of the website is transferred to a server of Google in the USA and stored there.

We have added the code “anonymizeIP” to Google Analytics. This ensures that all data is collected anonymously. Only in exceptional cases is the full IP address transferred to a server of Google in the USA and shortened there.

Why are we allowed to use Google Analytics?

Google evaluates the collected data on our behalf so that we can get an idea of the visits and user behavior on our website. This allows us to improve our services and the content and design of the website.

How does Google use your information?

With Google Analytics, Google uses the data on our behalf to evaluate your use of the website, to compile reports on website activities, and to provide further services related to website use and internet use to us.

Why are we allowed to use Google Analytics?

You can prevent the storage of cookies by adjusting the settings in your browser accordingly (see our remarks on cookies). You can deactivate Google Analytics by downloading and installing the Google browser add-on.

b) Google Ads

How does Google Ads work?

Google Ads conversion tracking sets a cookie on your computer if you have accessed our website via a Google ad. This is done for the purpose of tracking and performance determination.

What information do we receive, and how do we use it?

Each Google Ads customer receives a different cookie. Therefore, cookies cannot be tracked across the websites of Ads customers. If you visit certain pages of our website and the cookie has not yet expired, we and Google can see that you clicked on the ad and were redirected to that page. The information obtained with the conversion cookie is used to create conversion statistics for Ads customers who have opted for conversion tracking. We thereby learn the total number of users who clicked on our ad and were redirected to a page tagged with a conversion tracking tag. However, we do not receive any information that allows us to identify users like you personally. The cookies are also automatically deleted after 30 days.

Why are we allowed to use Google Ads?

If you are also logged in to your YouTube account, you would enable YouTube to directly associate your surfing behavior with your personal profile. We would like to point out that we have no knowledge of the specific content of the transmitted data or its use.

How can you prevent data collection?

If you do not want YouTube to associate the visit to our pages with your user account, please log out of your respective user account before using our website.
